Agreement to Terms

By accessing or using the TravelSmart web platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms constitute a legally binding agreement between you and NewEcom AI ("Company," "we," "our," or "us").

Eligibility

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Be a travel professional or operating a travel-related business
• Provide accurate and complete registration information

Description of Service

• Processes natural language travel requests to generate personalized itineraries
• Searches third-party travel suppliers for flights (400+ airlines via Amadeus) and hotels (2M+ properties)
• Creates professional branded proposals with shareable client web links and PDF export
• Tracks bookings, revenue, and commissions across 10+ supplier categories
• Manages a complete client CRM with preferences, loyalty programs, and travel documents
• Generates GEO-optimized itinerary pages for AI search visibility (Pro Plus)
• Provides marketing tools: video ads, agency landing page, blog, and lead capture (Pro Plus)

Important: The Platform does NOT directly book travel services, hold travel inventory, or process payments for travel bookings.

User Accounts

Registration

• Provide accurate, current, and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use at [email protected]

Termination

We may suspend or terminate your account for violations of these Terms, fraudulent activity, misuse of the Platform, or non-payment of subscription fees. You may cancel your subscription at any time through the Platform settings.

Acceptable Use Policy

You agree to

• Use the Platform only for lawful purposes
• Respect intellectual property rights
• Maintain confidentiality of client information
• Comply with all applicable travel industry regulations
• Use accurate information when creating itineraries

You agree not to

• Share your account credentials with others
• Generate spam or misleading content
• Reverse engineer or modify the Platform
• Circumvent usage limits or security measures
• Use automated scripts or bots
• Impersonate another person or entity
• Upload malicious content or code

Booking Responsibility: When clients book travel through supplier links, the contract is between you/your client and the supplier. TravelSmart is not a party to any booking.

Intellectual Property

Our IP

The Platform, including its design, features, content, and code, is owned by NewEcom AI and protected by copyright and trademark law. You may not copy, modify, distribute, or reverse-engineer the Platform.

Your Content

You retain ownership of content you create — itineraries, proposals, GEO pages, video ads. You grant us a limited license to host and process this content solely to provide the service.

Billing

Subscriptions are billed in advance via Stripe and renew automatically. You may cancel anytime before the renewal date.

Refunds

Subscription fees are non-refundable except as required by applicable law. Contact [email protected] for exceptional circumstances.

Overage Protection

No surprise charges — ever. Usage limits are visible in your dashboard and you will be warned before reaching them.

Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Travel Information: Prices, availability, and schedules come from third-party sources and may change. Always verify details directly with suppliers before booking.

AI-Generated Content: Itineraries, GEO pages, and blog posts are subject to your professional review before sharing with clients or publishing publicly.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWECOM AI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES; LOST PROFITS OR DATA; BUSINESS INTERRUPTION; OR DAMAGES FROM THIRD-PARTY SERVICES OR TRAVEL BOOKINGS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

• Client disputes related to your services
• Content you publish via GEO pages, landing pages, or blog features

Dispute Resolution

Informal Resolution

Contact [email protected] to attempt informal resolution within 30 days before filing a formal dispute.

Arbitration

Unresolved disputes shall be resolved through binding arbitration under the American Arbitration Association rules.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.

Governing Law

These Terms are governed by the laws of the State of Delaware, USA.

General Provisions

Provision	Detail
Entire Agreement	These Terms, together with our Privacy Policy, constitute the entire agreement between you and NewEcom AI.
Severability	If any provision is found unenforceable, remaining provisions continue in full effect.
Waiver	Failure to enforce any right does not constitute a waiver of that right.
Assignment	You may not assign these Terms. We may assign our rights without restriction.
Force Majeure	We are not liable for failures caused by circumstances beyond our reasonable control.
Changes to Terms	We may modify Terms at any time with notice. Continued use constitutes acceptance.
